1. Acceptance of Terms

By downloading, installing, or using FlashDrive Pro ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

FlashDrive Pro is a mobile application that transforms your smartphone into a local file server and productivity hub. The App enables:

• File sharing between your phone and devices on the same local network
• Live camera streaming to connected browsers
• Shared notepad for real-time text collaboration
• Kanban-style task board accessible from connected devices
• Shared tables for collaborative data management
• Clipboard synchronization between devices
• PIN-protected access control

All features operate exclusively over your local network (Wi-Fi or Personal Hotspot). No internet connection is required for core functionality.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or commercial purposes on devices you own or control, subject to these Terms. You may not:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Distribute, sublicense, lease, or rent the App to third parties
• Use the App for any unlawful purpose
• Remove or alter any proprietary notices or labels on the App

4. Purchase and Payment

• FlashDrive Pro is available for a one-time purchase price of $4.99 (USD) or equivalent in your local currency
• Payment is processed through the Apple App Store or Google Play Store
• All purchases are subject to the refund policies of the respective app store
• No subscriptions, in-app purchases, or recurring fees

5. User Responsibilities

You are responsible for:

• The content you share through the App. Do not share illegal, harmful, or unauthorized content.
• Securing your local network. The App makes files accessible to anyone on your network.
• Configuring PIN protection if you need to restrict access
• Ensuring you have the right to share any files you make available
• Maintaining the security of your device and network

6. Intellectual Property

The App, including its design, code, graphics, and documentation, is owned by FlashDrive Pro and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

7. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://flashdrive.pro/privacy.html. In summary: we do not collect, store, or transmit your personal data.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, or secure. We do not guarantee compatibility with all devices, operating systems, or network configurations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLASHDRIVE PRO, ITS DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Damages arising from unauthorized access to your shared files
• Damages arising from use or inability to use the App
• Any amount exceeding the purchase price you paid for the App ($4.99)

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

10. Indemnification

You agree to indemnify, defend, and hold harmless FlashDrive Pro and its developers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of a third party
• Content you share through the App

11. Termination

We may terminate or suspend your license to use the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, you must cease all use of the App and delete it from your devices. Sections 6, 8, 9, 10, and 13 survive termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify users through app store update notes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FlashDrive Pro regarding your use of the App and supersede all prior agreements and understandings.
